NOTICE TO BIDDERS AND
NOTICE OF PUBLIC HEARING
WATERLOO COMMUNITY SCHOOL DISTRICT PUBLIC IMPROVEMENT PROJECT HOOVER MIDDLE SCHOOL TRACK AND FIELD IMPROVEMENTS
Notice is Hereby Given:
A public hearing will be held by the School Board of the Waterloo Community School District on the proposed contract documents (plans, specifications, and form of contract) and an estimated cost for the proposed improvements at its meeting at 5:00 p.m. local time on March 24, 2025, at the Education Service Center, 1516 Washington St, Waterloo, IA 50702. At said time and place, any interested person may appear and file objections thereto.
Sealed proposals will be received by the School Board of the Waterloo Community School District at 1516 Washington St, Waterloo, IA 50702 for this work. Proposals must be filed before 2:00 p.m. local time on April 22, 2025, as hereinafter described in general and as described in detail in the Plans and Specifications for said improvements now on file at the Waterloo Community School District. Proposals will be opened and read aloud at that time.
Proposals will be acted on by the School Board of the Waterloo Community School District at a meeting to be held at 1516 Washington St, Waterloo, IA 50702, at 5:00 p.m. local time on April 28, 2025, or at such later time and place as may then be fixed. The Waterloo Community School District reserves the right to award the Contract at the time of said meeting or at such later time may then be fixed and to reject any or all bids and to waive technicalities and irregularities and to enter into such Contract as it shall deem to be for the best interests of said Owner.
The extent of the work involved is as follows: Installation of storm sewer improvements, new 400- meter track, long jump area, irrigated football field (including pump and controls), goal posts, fencing, concrete pavement, earthwork, and other Work indicated in the drawings and specifications.
Contract Time
The work under the contract shall actively commence within ten (10) days upon issuance of the Notice to Proceed, and shall be substantially completed on or before the 1st day of August 2025, subject to any changes in the contract period as provided for in these specifications, and granted by the School Board. The Work on this project shall be finally completed by, and ready for final payment, on or before the 15th day of August 2025, subject to any changes in the contract period as provided for in these specifications and granted by the School Board. This project is subject to liquidated damages as described within the project manual. The Notice to Proceed shall be issued at a preconstruction conference to be held at a future determined date after a fully executed contract.
Bid Security
Each proposal must be accompanied with a bid security as defined in Iowa Code Section 26.8, as security that the successful bidder will enter into a contract for the work bid upon and will furnish after the award of contract a corporate surety bond, in a form acceptable to the Jurisdiction, for the faithful performance of the
contract, in an amount equal to five percent (5%) of the amount of the contract. The bidder’s security shall be in the amount fixed in the Instruction to Bidders and shall be in the form of a cashier’s check or a certified check drawn on an FDIC insured bank in Iowa or on an FDIC insured bank chartered under the laws of the United States; or a certified share draft drawn on a credit union in Iowa or chartered under the

laws of the United States; or a bid bond on the form provided in the contract documents with corporate surety satisfactory to the Jurisdiction and filed in an envelope separate from the one containing the proposal. Said check or draft may be cashed or the bid bond declared forfeited by the Treasurer as liquidated damages in the event the successful bidder fails to enter into a Contract within fourteen (14) days and post bond satisfactory to the Owner insuring the faithful fulfillment of the Contract and maintenance of said improvements as required by law and the Specifications. The bid shall contain no condition except as provided in the specifications.
Award of Contract
Bidders shall not be permitted to withdraw their bids for a period of sixty (60) days after the date set for opening bids. The Owner reserves the right to reject any and all bids and to waive any informality in the bids received in the best interest of the Jurisdiction.
Bonding Requirements
The successful bidder will be required to furnish a performance and payment bond in the amount equal to 100% of the contract price at the time of contract execution. Each successful bidder will be required to furnish a corporate surety bond in an amount equal to 100% of its contract price. Said bond shall be issued by a responsible surety approved by the Waterloo Community School District and shall guarantee the faithful performance of the contract and the terms and conditions therein contained and shall guarantee the prompt payment of all material and labor, and protect and save harmless the Waterloo Community School District from claims and damages of any kind caused by the operations of the contract and shall also guarantee the maintenance of the improvement caused by failures in materials and construction for a period of one (1) year from the date of final acceptance of the work under the Contract.
Additional Provisions
Modification to the project documents may only be made by written addendum as issued by the Owner or Owner’s authorized Representative. The bidder’s proposal must be made on the forms provided within the bound project manual. Bidders must supply all required information prior to the time of bid opening. The Waterloo Community School District hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award.
The Waterloo Community School District of Waterloo, Iowa is exempt from paying Sales and Use Tax and will supply Contractor with an “Iowa Sales Tax Exemption Certificate” and an authorization letter to allow the Contractor to buy equipment and material for the project without paying Sales and Use tax.
Copies of project plans and specifications and form of contract are now on file for examination by bidders. Paper copies may also be obtained through Rapids Reproductions, 6201 Chancellor Dr., Cedar Falls, IA 50613, or calling 1-800-383-1223, upon deposit of fifty dollars ($50.00) which shall be refunded if plans and specifications are returned to Rapid Reproductions in good usable condition no later than fourteen (14) days following award of project. If the plans and specifications are not returned within the allotted time and in a reusable condition, the deposit shall be forfeited. Please call ahead to make sure that bidding documents are ready to pick up when you arrive.

Any bidder or equipment supplier whose firm or affiliate is listed in the GSA publication “List of Parties

Excluded from Federal Procurement and Non-procurement Programs” will be prohibited from the bidding process. Anyone submitting a bid who is listed in this publication will be determined to be a nonresponsive bidder in accordance with 40 CFR Part 31.
